SERVICE AGREEMENT - TERMS OF SERVICE FOR HELP 4 PAWS.

THIS SERVICE AGREEMENT IS INTEGRAL TO ANY WRITTEN OR VERBAL CONTRACT BETWEEN "HELP 4 PAWS" (HEREBY REFERRED TO AS "H4P") AND ANY CLIENT WHO CONTRACTS "H4P" TO TRANSPORT ANY ANIMAL.

WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012

If you sign the form provided, you will be agreeing that your rights to sue "H4P" under the Australian Consumer Law and Fair Trading Act 2012 are excluded, restricted or modified in the way set out in this form, if you are killed or injured because the services provided were not under the statutory guarantees outlined below.

Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that "H4P" is required to ensure that the services it supplies to you-

  • are rendered with due care and skill; and

  • are reasonably fit for any purpose which you, either expressly or by implication, make known to "H4P" and

  • might reasonably be expected to achieve any result you have made known to "H4P".

Under section 22 of the Australian Consumer Law and Fair Trading Act 2012, the exclusion of these statutory guarantees is brought to your attention by this form.

NOTE: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier's part. Gross negligence, concerning an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.

"Owner" or "Client" means any person, company or organisation that enters or is a party to a contract with "H4P" to transport an animal, including the consignor and the consignee.

"H4P" employees have the authority to enter a contract on behalf of "H4P" but have NO authority to vary this service agreement.

"Pet" or "Pets" means any animal, multiple animals provided to "H4P" to be transported.

All parties in the contract, including the owner, consignor, consignee, or any other party who places a booking with "H4P," shall be held to be the owner. They are deemed to have accepted this service agreement in full and are liable for all costs involved, plus any additional costs that may be incurred on their behalf during transport, including, but not limited to, veterinary fees.

Any person who engages "H4P" to transport a pet or delivers a pet to "H4P" to be transported, if they are not the registered owner, they acknowledge they have permission from the registered owner to arrange and deliver the pet to "H4P" for transport.

HELP 4 PAWS IS NOT A COMMON CARRIER AND ACCEPTS NO LIABILITY AS SUCH.

LIABILITY - While "H4P" conducts itself, giving the utmost care and attention to the client's pet, we will transport pets with the understanding that "H4P" will NOT be held responsible for any loss, illness, death, injury or accident due to any cause whatsoever.

Animal owners must notify "H4P" before travel of any relevant details that may influence the pet's safe transportation.

QUOTES - Quotes are provided by "H4P" based solely on the information provided by the owner. "H4P" reserves the right to alter the quote on pick-up if the information provided is incorrect or has changed.

PAYMENTA 50% non-refundable booking fee (included in the quote) is due at the time of booking, to be paid via debit or credit card over the phone. The total transport cost will be paid on the day the service is provided.

Preferred payment is via debit/credit card or direct bank transfer. "H4P" reserves the right to delay or cancel scheduled service until payment has been made.

SCHEDULED TIMES—While "H4P" will endeavor to keep as close as possible to our booking schedule, we may need to make changes to that schedule at short notice due to weather events, traffic, mechanical faults, or any other circumstances beyond our control. In these instances, "H4P" will NOT be liable for any costs incurred by the owner.

DANGEROUS ANIMALS—"H4P" reserves the right NOT to transport animals deemed dangerous to staff or other animals. This will be at the discretion of our staff members.

CANCELLATION POLICY - A full refund will be given if "H4P" cancels transport due to circumstances beyond our control. If the owner/client cancels the booking, "H4P" reserves the right to charge 50% of the quoted price if cancelled within 14 days of the scheduled pick-up. "H4P" reserves the right to charge 100% of the quoted price if the booking is cancelled within 7 days of scheduled pick-up. "H4P" reserves the right to charge a $100 cancellation fee if a booking is cancelled on route to the pick-up point.

VACCINATIONS - Through our service, a pet may encounter other pets in transit or while being exercised in a public area. Vaccinations ensure the pet is protected from communicable illnesses or diseases. Pets will NOT be transported without proof of immunisation. "H4P" will NOT be held responsible for any illness or disease contracted by vaccinated or non-vaccinated pets. The owner is responsible for ensuring their animal is protected and vaccinated.

SEDATION - "H4P" sedation policy requires animals not to travel while sedated; the only exception to this rule is if a Vet can provide a valid reason for the pet being sedated. The Vet must supply details about the type of sedation given and the dose administered. "H4P" can NOT be held liable for any complications arising from the need to sedate an animal while being transported. If required, our ambulance is fitted with OXYGEN, and the dose will be determined in consultation with the Vet. We also have oxygen/pulse monitoring equipment on board should it be required.

EXTREME WEATHER POLICY - Extreme weather may cause issues for our pet passengers. While water is available during the trip, hot weather can quickly dehydrate animals. On extreme weather days, we will endeavor to travel throughout the cooler parts of the day. Brachycephalic breeds will not be picked up for travel at the scheduled time if the temperature is expected to exceed 32 degrees. Other arrangements will be made. All our vehicles are air-conditioned for the comfort of the animal.

PRIVACY POLICY—"H4P" collects sensitive and non-sensitive data from the owner, owner's representative, consignor, and consignee. It is collected solely to enable "H4P" to fulfill its obligation to transport the pet. This data may be disclosed to third parties, including but not limited to our staff, veterinarians, third-party transporters, and individuals with whom we would expect to share data. WE DO NOT SELL YOUR INFORMATION UNDER ANY CIRCUMSTANCES.

PHOTOS / VIDEOS - "H4P" reserves the right to reproduce photographs or videos of pets who have travelled with us for use in updates, advertising campaigns, on our websites or our social media pages. "H4P" will NOT accept liability for claims or losses made concerning the use of photographs or videos in these ways.
